Ted Olson and David Boies – Prop 8 – “We’re Going to Win This Case”

Attorneys Ted Olson and David Boise met with press today to announce their involvement in the battle for equal protection for gays and lesbians seeking same sex marriage rights in California. Boise, who represented Al Gore in the 2000 United States Supreme Court case Bush v. Gore, stated that the courts exist to “reverse injustices” and insure that federal constitutional protections reach everyone. He publicly asked President Obama and the legislative and judicial branches to “move forward” with initiatives that protect same sex rights.
“This is not a partisan issue,” Olson retorted when asked about his relationship with the Federalist Society, a group of conservatives and libertarians. Olson, who represented George Bush in Bush v Gore, went on to point out that same sex marriage rights are protected by due process and equal protection clauses of the U.S. Constitution.
The attorneys interpreted yesterday’s California court ruling as confirming that California may amend its constitution by use of popular vote without violating federal constitutional laws. They added that yesterday’s decision did not reach the question of whether the ban on same sex marriage is in fact a violation of federally protected rights under the U.S. Constitution.
Both attorneys feel strongly that federal courts are ready to resolve the same sex marriage issue in a manner favorable to gays and lesbians. “We’re going to win this case,” Olson said.
